Terms & conditions valid from 1st July 2024:

 

1. General

 

The following terms and conditions govern your use of the website misbhv.com or other website, microsite, or mobile device application (jointly referred to as ”misbhv.com” or “Store”), owned or operated by MISBHV SP. Z O.O., hereinafter referred to as “MISBHV”, ”us ” or ”we”, and establish the terms and conditions for the sales made between you - wishing to purchase MISBHV products - and GLOBAL-E NL B.V. a company incorporated in The Netherlands with registered number 72541466 whose registered office is at Krijn Taconiskade 430 1087 HW Amsterdam, (hereinafter referred to as "Global-e”) operating as a seller.

Please ensure you have read and understood the Terms before placing your order. A prerequisite for starting to use the Store and placing orders is reading and accepting these Regulations.

The inclusion of any products or services on misbhv.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

Customers registering in the Store and placing orders there provide their personal data and consent to its processing by MISBHV sp. z o.o. under the terms of the MISBHV’s Privacy Policy, and by Global-e under the terms of the Global-e Privacy Policy.

The Customers have the opportunity to use the Store by registering and thus creating a private account (hereinafter referred to as "Customer Account"), in which personal data and information about the Customer relating to his/her orders placed in the Store are collected and without registering. The Customer has the right to terminate the agreement concluded with MISBHV concerning the Customer Account at any time by submitting to MISBHV a declaration of intent to delete the Customer Account. For this purpose, the Customer should contact the MISBHV or use the functions provided in the Customer Account.

The Customer shall be liable for providing false personal data. MISBHV reserves the right to refuse to process and cancel a product order in a situation where the Customer has provided false data or where the data raises reasonable doubts of the MISBHV as to its correctness. In such a case, the Customer will be informed by phone or e-mail about the reasons for cancellation of the order. In such a situation, the Customer has the right to explain all circumstances related to the verification of the veracity of the data provided and the cancellation of the order. In the absence of data allowing MISBHV to process the order, MISBHV will provide any explanations after the Customer has made contact.

The Customer is responsible for all transactions that were carried out using the login and password, unless the login or password information was disclosed to a third party through no fault of the Customer. MISBHV undertakes to make every effort to protect the login and password from disclosure. The customer undertakes to make every effort to protect the login and password from disclosure to unauthorized third parties.

MISBHV is not responsible for the transfer by the Customer of its login or password to the Customer's Account to third parties. In case of expiration, change or deletion of the e-mail account provided by the Customer at the time of registration of the Customer Account, the Customer should inform MISBHV.
The Customer declares that all data provided by him/her for the purpose of processing the order are true, while the MISBHV is not obliged to verify their veracity and correctness.

MISBHV wants to provide the best possible online experience. To make this possible we need to ensure that our services run like clockwork. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

Use of the Store is not permitted for persons under eighteen (18) years of age (or the age of majority in effect in your country).

 

 2. Prices and delivery charges

 

The prices displayed at misbhv.com include the statutory Value Added Tax for European Union countries, but do not include import duties, fees and taxes upon delivery for third countries. The final purchase price and delivery cost will be presented to the Client at the checkout in accordance with the Global-e terms of sale.

 

3. Ordering/conclusion of contract

 

Global-e has agreement with MISBHV, to make MISBHV’s Products available to you for purchase from, and delivered by, Global-e.

By placing an order via the Checkout ("Order"), you acknowledge that the seller is Global-e and not MISBHV, and that upon successful verification by Global-e of your Order and payment information, Global-e will sell ordered products to you in accordance with these Global-e terms of sale.

 

4. Delivery

 

Before you place your order, you will be informed of the expected delivery details and cost.

5. Customs Duties & Taxes

 

All countries within the European Union have Value Added Tax included in the final price.

6. Returns

 

You can return any item to us within 30 days of receiving your original order, including sale items. Remember that the merchandise must be unworn and unwashed with all the MISBHV tags attached. We do not accept exchanges on returned items, but you can send them back for a refund and then place a new order for the size, color or item you’d prefer. 7. Payment methods

 

Available payment methods and all necessary information you will find at check-out and in the Global-e terms of sale.

 

8. Guarantee

 

If there are defects in the goods you have purchased, MISBHV abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.

 

9. Severance

 

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

 

10. Ownership of rights

 

All intellectual property rights, such as trademarks and copyrights at misbhv.com remain with MISBHV sp. z o.o. and its subsidiaries or licensors. Any use of misbhv.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of MISBHV.

12. Final Provisions

 

Polish law applies to these Terms and Conditions. Any dispute arising out of or relating to these Terms and Conditions or any non-contractual obligations arising out of or relating to these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of Poland or the jurisdiction of the courts of your place of residence, if so provided by applicable law.

 

These Regulations do not exclude and do not limit any rights of the Customer who is a Consumer, which he is entitled to under the mandatory provisions of law. In the event of a contradiction between the provisions of these Regulations and the mandatory provisions of law granting broader rights to Consumers, these provisions shall prevail.

 

MISBHV reserves the right to amend the provisions of these Regulations for important reasons, in particular:

a) in order to adapt them to generally applicable laws,

(b) in order to eliminate possible provisions that may violate the interests of Customers,

c) in connection with a change or expansion of the range of services and goods provided by the Store,

d) in connection with a change, limitation or expansion of the business profile of MISBHV,

e) in connection with organizational changes on the part of MISBHV.

 

The Customer will be notified of any change in the Terms and Conditions to the e-mail address indicated when placing the order.

 

If changes are made to the Terms and Conditions, the Store will inform Customers of the new content of the Terms and Conditions electronically (to the e-mail addresses indicated in the Customer Account or when placing orders) and by publishing the new Terms and Conditions on the Store's website, at least 14 days before the new Terms and Conditions come into effect. If the Customer does not accept the content of the new Regulations, he/she has the right to terminate the contract concluded with MISBHV regarding the Customer Account at any time by submitting a declaration of intent to delete the Customer Account.

 

In the event that any of the provisions of these Terms and Conditions is amended or invalidated, as a result of a final court decision, the remaining provisions of these Terms and Conditions shall remain in force and bind the parties.

 

Please be informed that any comments and suggestions from Customers are always welcome and desirable from the point of view of MISBHV's policy, the main objective of which is to act in the interests of the Store's Customers. In order to send comments and suggestions, or if the Customer believes that his or her rights have been violated, or if the national laws applicable to the Customer grant him or her greater legal protection than the provisions of these terms and conditions, please use the contact form or send information to the e-mail address: store@misbhv.com. The Store will then try to take his suggestion into account as far as possible and grant protection to his rights.

 

The Client can decide to access to the platform for alternative extra-judicial resolution of disputes provided by the European Commission, available on the website http://ec.europa.eu/odr.
